Internet Banking Service Agreement

Types of Transactions or Services for Personal Customers only

You may use the Empower Internet Banking Service ("Internet Banking") to:

  • Obtain balance and information
  • Transfer funds between your accounts with us
  • Download account information
  • Request a stop payment
  • Communicate through Internet Banking with us via bank mail
  • Pay bills through our bill payment feature

Limit/Cut-Off Times

Payments and transfers made after the following cutoff times will be posited the next business day:

  • Internet Banking Bill Payments: 4:00 p.m. EST
  • Internet Banking Transfer: 4:00 p.m. EST

Note: Transfers done against uncollected, insufficient, or unavailable funds will be subject to applicable fees and may be reversed the next business day. You agree to notify us promptly if a transfer you initiated was not completed.

Account Access, Features, Benefits and Requirements

Eligible Accounts Include:
Deposit Accounts: checking, savings, moneymarket, club, IRA and certificate of deposit Loan Accounts: home equity, personal loan, automobile loan, line of credit and mortgages. We reserve the right to limit the types of accounts that are available for this Service.

By enrolling, you authorize us to provide you with access to all eligible accounts held in your name and/or held jointly with others that are open at the time Internet Banking is initially provided or opened in the future. Accounts requiring more than one signature are not eligible for transfers.

ADDIONAL DISCLOSURES REGARDING WAB INTERNET BANKING ARE CONTAINED IN THE PERSONAL DEPOSIT AND ELECTRONIC BANKING SERVICES AGREEMENT AND DISCLOSURE, AND TOGETHER WITH THESE DISCLOSURES, CONSTITUTE THE ENTIRE DISCLOSURES REQUIRED BY LAW.

  • Fees
    You agree to pay and hereby authorize us to debit your account(s) for the charges or fees which are imposed by us for Internet Banking, or for services which may later be offered, as such fees or charges may be imposed or changed from time to time.

    Currently, there are no fees charged for using Internet Banking without the bill payment option. We reserve the right to impose or change fees for Internet Banking and charge your account(s) for these fees at any time after such notice, if any, is required by law.
  • Bill Payment Option Fees per Enrollment:
    Free

Transfers

Transfers requested after 9 p.m. on a business day or on a non-business day (Saturday, Sunday, Federal holiday on which no bank processing occurs, or other day we are closed) will be posted to your account the next business day. Transfers requested from uncollected, insufficient or unavailable funds will be subject to applicable fees and may be reversed the next day. You agree to notify us promptly if a transfer you initiated was not completed.

Bill Payment Option

You may use Internet Banking to pay bills, if you choose the bill payment option. When you sign up for the bill payment option, you must designate a checking account from which to pay bills. With the bill payment service, you may make payments to companies or individuals you select.

  • Business Days for Bill Payments
    Business days include any day other than a Saturday, Sunday or Federal Holiday.
  • When Funds Will be Withdrawn from your Account
    When you schedule a bill payment using Internet Banking, you authorize us to immediately withdraw the necessary funds from your designated checking account with us on the scheduled payment initiation date. The scheduled payment initiation date is the date you have instructed us to begin processing your payment. All scheduled payment dates selected by you must be at least five (5) business days before the date your payment is due. We will not process a payment if sufficient funds, including funds available under any overdraft protection, are not available in your designated checking account on the scheduled payment date.
  • Payment Dates and Processing
    Payments may be made by electronic means or by draft mailed to the payee. While it is anticipated that most transactions will be processed and completed on the day after your selected scheduled payment initiation date and arrive approximately four (4) business days after your selected scheduled payment initiation date, it is understood that due to circumstances beyond our control, particularly delays in handling and posting payments by slow responding companies or financial institutions, some transactions may take a day or even a few days longer to post to your account with the designated payee. For this reason, it is recommended that all scheduled payment initiation dates selected by you be at least five (5) business days before the actual due date and not the late date or grace period.
  • Notice of Incomplete Transactions
    You agree to notify us promptly if you receive a notice from anyone that a payment you made through Internet Banking has not been completed or remains unpaid.
  • Payment Liability
    Payments made through Internet Banking require sufficient time for the payee to credit your account properly. To avoid late charges by the payee, you must schedule a payment to be processed sufficiently in advance of the due date of your payment. We cannot guarantee prompt receipt and processing of payments by payees. We shall not be responsible for any charges imposed or other action taken by a payee resulting from a late payment, including but not limited to finance charges and late fees. If you properly follow the procedures described in the section above, and we fail to send a payment according to the payment instructions received, we will bear responsibility for all late charges. In any other event, including but not limited to choosing a selected payment date which is not five (5) business days before the due date, or on or past the due date stated on your invoice, the risk of incurring and responsibility for paying any and all late charges or penalties shall be borne by you. We will use our best effort to make all your payments properly. However, we shall incur no liability if we are unable to complete any payments initiated by you through Internet Banking because of the existence of anyone or more of the following circumstances:

    I. Your account does not contain sufficient funds to complete the payment or transfer, or the payment or transfer would exceed the available balance of your overdraft protection account, or
    2. Internet Banking is not working properly and you know or have been advised by us of the malfunction before you execute the transaction, or
    3. The payee mishandles or delays a payment sent by us, or
    4. You have not provided us with the correct names of persons or entities to whom you wish to pay or have not given us complete and current instructions, or
    5. You have not properly followed instructions on how to make a transfer or bill payment, or
    6. You do not authorize a bill payment soon enough for your payment to be made and properly credited by the payee by the time it is due, or
    7. We believe that a transaction may be unauthorized, or
    8. Your equipment was not working properly and this problem should have been apparent to you when you attempted to authorize a transfer or bill payment, or
    9. Circumstances beyond our control (such as, but not limited to, fire, flood, interruption in telephone service or other communication lines, interference from an outside force or delays in mail service) prevent the proper execution of the transaction and we have taken reasonable precautions to avoid those circumstances.
    Procedure to Cancel Bill Payments
    To cancel a payment on an electronic bill payment transaction, you must call us. Canceled payments through Internet Banking must be received at least 1 (one) business day before the scheduled payment initiation date that you indicated. If we don't receive your instruction to cancel an electronic bill payment transaction before that time, we may process the transaction.
    To Stop a Bill Payment In Process
    To stop a payment on or after the scheduled payment initiation date, you must contact the merchant or other payee directly.
  • Stop Payments Not Issued Through the Bill Payment Option

    You may request a stop payment of paper checks that have not posted to your account, in accordance with our normal stop payment procedures listed in our Deposit Account Agreements, as applicable, by completing and submitting the stop payment request form provided in Internet Banking. Requests received during non-business hours or on non-business days will be processed at the beginning of the next business day. All requests are subject to our normal stop payment fee.

    User ID and Password

    In order to access Internet Banking, each account owner must use a USER ID and password. You will be provided with information on your USER ID and an initial password to access Internet Banking. After keying in the initial password, you will be required to immediately change your password. You should keep your password in a secure location. The password identifies the user of Internet Banking as an individual who is authorized to access the account(s) and validates any instructions given through Internet Banking, just as the actual signature and other proof otherwise identifies and validates instructions of the account owner(s). The use of the password with Internet Banking is a security method by which we are helping you to maintain the security of your account.

    Your password is an identification code that is personal and confidential. YOU AGREE TO TAKE ALL REASONABLE PRECAUTIONS THAT NO ONE ELSE LEARNS YOUR PASSWORD. If you believe your password has been lost or stolen or that unauthorized access to or transfer(s) from your account(s) has occurred or may occur, you should contact us immediately. You may be denied access to Internet Banking until Internet Banking is reactivated and a new password is selected.

    Equipment and Software Requirements

    In order to use Internet Banking, you will need a computer with an Internet connection and a Internet browser that supports 128-bit encryption, (such as Netscape Navigator or Microsoft Internet Explorer) or an equivalent. You are responsible for the set-up and maintenance of your computer and Internet connection.

    Liability

    You agree that we are not responsible for any errors or failures from any malfunction of your computer or any virus or problems related to the use of Internet banking. We are not responsible for damages arising from the use or maintenance of other Financial Software used to access or communicate with Internet Banking.

    You agree to cooperate with us in the investigation of any claim or dispute and provide us with information and documentation as may be necessary in order to assist us in resolving your claim or dispute.

    YOU AGREE TO BE RESPONSIBLE FOR ANY AND ALL USE OF THE USER ID AND PASSWORD AND INTERNET BANKING, THE BROWSER. AND ANY TRANSACTIONS CONDUCTED USING INTERNET BANKING. WE WILL NOT BE RESPONSIBLE FOR ANY LOSSES OR DAMAGES FROM THE USE OF INTERNET BANKING OR THE BROWSER. INCLUDING DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL LOSSES OR DAMAGES. WE WILL NOT BE RESPONSIBLE FOR ANY LOSSES OR DAMAGES BECAUSE OF FAILURE OR DELAY IN THE DELIVERY OR PROCESSING OF ANY PAYMENT, NOT CAUSED BY US OR OUR AGENT .WE DO NOT WARRANT YOUR EQUIPMENT, THE SOFTWARE, OR THE BROWSER OR THAT THEY ARE MERCHANTABLE OR FIT FOR A PARTICULAR PURPOSE, OR OTHERWISE. ANY PROBLEMS WITH YOUR EQUIPMENT, THE SOFTWARE, OR THE BROWSER MUST BE RESOLVED DIRECTLY WITH THE MANUFACTURER OR OTHER SUPPLIER. WE DO NOT WARRANT THAT YOUR USE OF INTERNET BANKING WILL BE UNINTERRUPTED OR THAT OPERATION OF INTERNET BANKING WILL BE ERROR FREE OR SECURE.

    Termination or Discontinuation

    You may terminate Internet Banking by e-mailing us, calling us, or by writing to us. If you terminate Internet Banking, you authorize us to continue making those transfers and payments that you had scheduled or paid for prior to termination. We have the right to refuse or revoke access to or terminate Internet Banking at any time, without cause or notice or refund of previously charged or accrued fees. We may also refuse to make any transfer or payment to any payee without cause or notice. Your privileges may also be revoked if the account that is used with Internet Banking becomes overdrawn. If we terminate your use of Internet Banking, we reserve the right to make no further transfers or payments from your designated account, including any transactions you previously authorized. Neither termination nor discontinuation of Internet Banking shall affect your liability or obligation under this Agreement.

    Note: Certain accounts may require the use of Internet Banking. These accounts will need to be convened to an account not requiring Internet Banking in order to discontinue the service.
